    Judge Sues Boss, Fellow Judges, For Not Enforcing State Domestic Violence Law Posted by JERRY REMMERS, Columnist in At TMV, Breaking News, Law. May 8th, 2010 In San Diego, at least, this has never happened before: A superior court judge is suing her presiding judge and all other judges in the San Diego court system for not enforcing a state law which she says must be imposed on all domestic violence defendants. Judge DeAnn Salcido at a news conference Friday denied she was taking the action because her court seat is being challenged in the June 8 primary by a right-wing conservative group, BetterCourtsNow, supporting Harold Coleman, a court arbitrator and attorney. In court papers, Salcido claims she is being harassed by fellow judges and presiding Judge Peter Deddeh in the East County Branch where she has served since her 2002 appointment. She is petitioning the 4th District Court of Appeal, asking the court to order judges to impose all conditions of probation called for under state law for domestic violence offenders. She said those conditions include requiring domestic violence probationers to take a one-year course on domestic violence, issuing orders into a statewide database that are intended to provide people with protection from defendants. and ordering defendants to relinquish any firearms they may own. She said she determined a pattern of other judges not complying with the law and they turned against her when her clerk began checking court documents. “There is a culture in the San Diego court system that puts plea bargains ahead of public safety,” she said. At the news conference, Salcido singled out Judge Deddeh for the plea bargain that gave John Gardner an early release in a sex molestation case in 2000. Gardner is the confessed killer in the sensational murder cases drawing national attention of teenagers Amber Dubois and Chelsea King. No judges nor the court’s attorney would comment publicly on Salcido’s petition suit because of ethics rules.

    Re: Death of Mary Gennotti

    Knowing the past history of my (relation omitted) Mary Gennotti I feel compelled to inform the court of one of the worst kinds of betrayal and fraud that is being presented concerning the death and will of Mary Gennotti.

    Mary died 27th of March 2009 in the Kindred Nursing Home in New London, Ct. The cause of death was Glioblastoma Neoplasia @ Temparallous, interval for months and degenerative dementia, for years One month before her death a marriage was performed by Shirley Alloway between Frank Gennotti and Mary Gennotti. Mary was not even aware enough or well enough to sign her name. An “X” was in place of her signature.

    A clerk of the Records Office of the New London City Hall, not a qualified medical person is the one that signed that Mary was of sound mind. It is extremely doubtful that Mary was aware of what was happening to her because until she was forced into seclusion by her daughter Ann Teft, Mary never wanted to be in the same room as her daughter Ann or former husband, Frank Gennotti, much less re-married to him.

    In December of 1988 her daughter Ann was not allowed unsupervised visits when Mary was in the hospital after an automobile accident. The reason for the supervised visits was because Ann had exhibited violence toward her mother in the hospital. Several months before the accident Ann had held a loaded gun against her mother’s head and threatened to kill her.

    Mary knew that within a few months of her leaving the hospital her husband Frank was having an affair with Josephine (last name omitted) of Elm Street in New London, CT and this was before the divorce was final. He was well known as a womanizer and a thief.

    Mary was also afraid of her husband Frank Gennotti to the point of having a restraining order against him. The restraining order did not stop him from trying to break into her home. Even though the police were called when he was caught trying to break into Mary’s house, nothing was done about it. Frank was on the New London Police Department and was protected by the “blue brotherhood”. After that happened, she went to live next door with her brother and mother Robert and Josephine.

    Mary not only divorced her husband in 1990 she also would have nothing to do with her daughter Ann. For a couple of years prior to 1988 Mary started proceedings for divorce. She was adamant about not wanting to live with her husband. She even slept on the couch to avoid him. Two of the reasons she not longer wanted to be associated with him was because of his cheating on her with other women. He not only had been having affairs with other women (Millie (Last name omitted)was another one of his conquests), he also harassed other female relatives, including Mary’s (name omitted) who had to call her father,to get him away from her house. He also harassed many of the women in our family, including me. The other reason Mary did not want anything to do with Frank Gennotti was because of his stealing. She was afraid they were going to lose his pension and be disgraced if and when he was caught. Mary not only divorced her husband in 1990 she also would have nothing to do with her daughter Ann who was upset about the divorce and made her mother’s life miserable, whenever she was around.

    I visited them often in the home and for a substantial length of time went there for lunch on a daily basis. During these visits Mary would tell me about her feelings toward her daughter and ex-husband, including all of the above facts. It always was all negative to the point of not even wanting to see photos of either of them.

    After Mary went to live with the family she literally begged her son Robert Joseph to come and live in her house. The house that her father and her brothers Robert, and Melvin,Jr. built and gave to Mary when she originally married Frank Gennotti.

    Mary wanted to make sure that neither her ex-husband nor her daughter Ann, nor her son Frank, Jr. would be able to take any part of that house after her death, so she signed it over to her youngest child, Robert Joseph Gennotti. He and his fiance gave up a lovely condo and went to live in the house on Summer Street to be near his mother, who was still living next door with her mother and brother.

    In August of 2003 Mary’s son Frank, Jr. came from Florida for a visit. Mary called him and he invited his mother to go out to dinner. When Mary left with Frank, Jr. she said she would be back in a couple of hours, she was just going to dinner. A few hours later Frank, Jr. returned and said his mother was going to stay with his girlfriend on Perry Street and she needed some personal items. The next day he came with a pickup truck and said his mother was going to stay with his girl friend for awhile. He even took the TV. Mary’s brother took photos of a lot of the things he took.

    After that no one heard from Mary. None of her family (mother, brothers, sister) nor any of her first cousins ever saw or spoke with her. When inquiries were made we were told she was living in a trailer and did not want to see anyone. We all knew that could not be true because Mary was always afraid to stay alone and would never choose to do so, especially not in a trailer. In the meantime, Frank, Jr. was threatening to kill his brother Robert Joseph because his name was on the house and various financial accounts of Mary’s.

    When Mary’s mother Josephine died on May 7, 2005,1 called Ann Teft’s house to let them know of the death. When I told Mary, she told me she did not care and would not be going to the wake or funeral. Her mother was nothing to her and she was not interested. I expressed surprise at her attitude because I was very much aware of the loving relationship between Mary and her mother. Mary always had expressed her deep gratitude to her mother and brother for keeping her safe, happy and involved in a loving family relationship, since that was not possible with three members of her immediate family. She again told me her mother was nothing to her and she was not interested. I then told her I did not believe that and I wanted to know who was telling her to say such terrible things. As soon as I said this, Ann started yelling at me, saying that no one was telling her mother what to say, none of them were interested in anything to do with the (omitted) family. It was obvious that Ann was listening to the conversation and strongly objected to my question. The phone was not given back to Mary before being hung up. There was no answer when I tried to call back.

    Several years prior to Mary’s being taken by her daughter Ann Teft, and while Mary was of sound mind, she had a Will made with her attorney. There was no doubt as to the legality of the document or its contents. That is the Will that needs to be honored as Mary Gennotti’s Last Will and Testament.

    I truly believe that the stress and fear of being forced to live with her daughter Ann Teft added to Mary’s dementia and development of a brain tumor. I truly believe that a new Will was made after Mary was no longer in control of her own mind, and the re-marriage to her ex-husband, just before her death, was arranged without her knowledge or consent.

    The purpose of this letter is to create enough doubt for an investigation to take place. If that happens, I am sure the original Will will be considered to be Mary’s final wishes.

    In response to you letter dated July 29, 2009 about providing additional information I reluctantly offer the following, aware of retaliation.

    Frank Gennotti, Sr., having retired from the New London Police Department, opened a pizza house on Pequot Avenue in New London. His establishment did not make deliveries.

    I was called to 72 Summer St., his residence, by (name omitted) Mary A. Gennotti, his wife. She asked me to document the following items, which were stolen by Frank and one of his accomplices, (Name withheld), from a robbery of the Millstone Power Plant in Waterford, Ct.; He brought these items to the basement of his residence, which was unusual.

    I was able to gather, this partial list, of some of the contraband but was forced to leave before discovery.

    I did not list all or amounts because of security reasons. Mary called Millstone security about one of the robberies but was overheard by her daughter which gave her a beating before notifying her father Frank. He informed Mary that if he and his friends got in trouble over her call he would kill her and her youngest son Bob with the gun he stole from the police department that he claimed couldn’t be traced.

    This is how it was accomplished. Frank Gennotti, Sr. would receive a telephones call from one of his contacts, at Millstone, requesting a pizza delivery. He would be told where to park his vehicle and it would be loaded with stolen items. He blocked the side and rear windows, of his vehicle, with hand written makeshift signs, to hide the evidence. He would then just drive out.

    I am reluctant to go further for fear of reprisal due to the many earlier cover-ups, which are famous, in the New London Judicial System. I have omitted names to protect, my safety, and the families of the criminals. I have not heard from your staff as stated in the above mentioned letter.

    Dear Judge Knierim,

    I request the immediate removal of probate judge Mathew H. Green of New London, Ct. from the estate of my late mother (Name withheld). It is obvious that the decision made by the judge, is fraudulent, and was based on something other then the testimony. The evidence presented clearly refutes his determination. Unfortunately, there was no court stenographer present. He also ruled on an account, “Joint tenants with right of survivorship” that, by law, does not go through probate.

    I am convinced his decision, is what I will term, “Judicial Malpractice,” and based on my written complaints, to Connecticut Governor Jodi Rell, Attorney General Richard Blumenthal, and your office about his improper decision, in the estate of (Name and relation omitted.) Evidence provided from two relatives was ignored and his quick decision lacks merit. Also ignored, was about twenty three pages of previously handwritten evidence from my deceased sister. I was told by two attorneys that he would not object to the new will because it was written by his close attorney friend who he sends clients too.

    My mother died on May 7, 2005 and still he has not made a finding on whether, the will, prepared by an attorney, and in effect for over twelve years is valid.

    As a result I have experienced an estate valued at about one half million dollars reduced to me having to apply for food stamps. Also, I was refused the low income, elderly discount on the property taxes, since 2005 of one thousand yearly because technically I am not considered the owner.

    I informed the judge, in June of 2005 that twenty three feet of the rear roof was leaking. His reply was that,” we better hurry up then.” During the cold winter months, for the last five years, I am required to wear my clothes to bed to try and keep warm.

    I was unable to attend the hearing just a couple of days ago because I injured my back splitting logs at the age of 72. He denied my request for a delay and paid a lawyer, who did absolutely nothing $ 6,875.00, apparently as a gift. This is not justice, but, “Probate Domestic Violence.”

    In closing I am willing to submit to a polygraph exam to support my court testimony.

    Dear Judge Greene
    As instructed, in a letter, by my attorney, (name omitted),I am enclosing documented evidence to support my objection to the admission of the will dated March 4, 2004. The will contains at least two errors and Mary would have only endorsed it under duress. I challenge any legal action, or document, she was pressured to endorse after August 2003, including her marriage on Feb. 27, 2009. The evidence to support these allegations is overwhelming.

    It is in the interest of the court to investigate the abduction and incarceration of Mary. Why would Mary engage in legal action, police investigations, restraining orders, and spend about fourteen thousand dollars for a divorce to remarry Frank just days before her death? She was heavily medicated and unable to sign her name. A few months before, while a patient in L & M hospital, she could not recognize close relatives. Also, those involved did not place her legal name on the marriage license. This is more than curious.

    Her death was kept a secret; no relatives, including her son Bob, were notified. The funeral parlor was told not to give out any information. A party was held after her burial at ocean beach and they were instructed to keep it quiet. Why? Only several days after her death did her relatives find out, by a private source. A death notice was not even placed in the local newspaper.

    Mary was well aware that a conspiracy existed to get her over to Ann Tefft’s house and that is why she refused, many of her sons Frank, Jr’s, dinner invitations. On Aug. 27, 2003 the opportunities arouse. Mary called Frank, Jr. to take her out to dinner. She said she would be home later. Frank, Jr. made an unusual remark as he left, “I will do anything for my father.”

    Later that evening, Frank, Jr. came over and said that Mary was staying at his girlfriend’s house on Perry St. and needed a few personal items and would return home tomorrow. The next day he came over with a truck, his girlfriend, a guy and demanded all of her items including her T. V. I took photos of the event. He said Mary was getting an apartment on Perry Street, in a building his girlfriend’s brother owns. He had taken Mary directly to Ann Tefft’s house and had lied about it. (He testified in court that Mary did not know he was taking her there.) I learned later that he had talked to Bobby Joe and threatened to kill him. Prior to this, he came to the house; several times arguing with Mary to give him the money she had in Merrill Lynch. He told her he could make a lot more money selling cars then Merrill Lynch could make her.

    Within one month of her abduction her Merrill Lynch account was sold at a loss of thirteen thousand dollars. A few months later the forcing of a new will, and then a ridiculous law suit purporting to be from Mary but known to be from Ann Gennotti Tefft. She had already sued Frank, Jr., three Uncles and threatened to sue Bobby Joe.

    Frank Jr., was sued for breaking Ann’s nose during one of her attacks on her mother. Mary ran from her house during this attack and was attacked again on the sidewalk, in front of her house. Ann’s nose was broken by her brother Frank, Jr. He told me that, “I didn’t break her nose by punching her in it. Ann had her hands so tight around my mother’s throat that I couldn’t pry them loose. I broke it by punching her in the jaw.” Mary was taken to the doctor to receive treatment. In November of 1988 Ann held a loaded gun to Mary’s head and threatened to shoot her.

    When Mary was a patient at L& M for a head injury, sustained in a car accident, Ann attacked her and was banned from the hospital. Ann returned and informed hospital staff that the neurological group had given her permission to return. The group was called and they said she was not given permission and when she refused to leave the hospital had to get two security guards to carry her out. When she was allowed back she had to have hospital supervised visits. During the five weeks Mary was a patient her husband never visited her.

    If you need additional proof of the relation ship between Mary and Ann there is the testimony of two neighbors, in the law suit, which will provide it. Also, at Mary’s deposition she stated that she, Mary, had never seen the law suit until the day before.

    My purpose is to obtain justice for Mary something she, tried to get, but, couldn’t acquire in life. I provide the names of the following attorneys who knew Ann as additional proof.

    Michael Petrides, June 1994, a court counselor/mediator met with Ann on several occasions and said she had a seriously disturbed mind and there would be no joint counseling or meeting between Ann and us, Robert, David, and Melvin. He felt Ann would make a joint meeting confrontational and maybe dangerous, he said she had become fixed on this issue and part of the disorder was that she couldn’t accept any responsibility for the fact that her mother didn’t want to see her and not being able to blame herself. He described Ann’s condition as psychotic which he said was a very serious mental disorder. He said she had the classic symptoms. He said she presented a danger to us and would probably never let up. He added that Ann needed intensive therapy, and possibly institutional commitment. The above was by order of a court decision and a report should be at Attorneys at Law.     Has it been 35 years already? It was Christmas Eve 1973 that a hit-and-run driver took the life of my big brother, changing our family’s lives forever.

    The event shook this community, the aftershocks continuing for years. My mother’s unflinching and relentless search for justice was often ridiculed. Yet, it was interesting to stand beside her and watch what crawled from beneath the rocks she disturbed.

    My fervent hope is that New London and Connecticut have learned something from the glaring errors and inconsistencies that met us in our explorations. I trust that this city and state are better places now because of it.

    All that is left of Kevin Showalter is his cemetery plot and some boxes of his things that sit in my study. I’ve kept his drawings, some treasured clothes and a few other knick-knacks that remind me of him.

    But, except for my other brother and his family, I hardly speak with anyone now who ever knew Kevin. He lived only 20 years and our memory of him has had a long time to fade. Lucille M. Showalter’s tireless search for the answers in her son’s killing ended on May 10, 2000, when she lost her battle with cancer.

    My faith tells me that all my mother’s questions have found their answers now. But for me, after all these years, the question remains: Who killed my brother?

    Was it the late Harvey Mallove, a man in the wrong place at the wrong time, with a story that no one could corroborate?

    Was it Paul Hansen, also deceased, a man who woke up from a night of driving and heavy drinking to find his car damaged and no memory of where he’d been or what
    might have happened?

    I don’t know.

    Elusive answers

    I’ve concluded I will never really know the answer. This also means I have no one to vent my anger at for being the killer. So, I don’t. I can say it now that it was deplorable that police botched the official investigation from the start. The fraternal order of machismo and paternalism ruled the minds of those entrusted to deal with a grieving mother and her still-wet-behind-the-ears 14-year-old sidekick.

    Quieting the complainant seemed more important than solving the case. Police assured us they would take care of everything and that our job was to keep quiet and let them work. But it appeared what was getting hushed was the truth and that no one really wanted to tell us anything.

    It is so good to know these days are past. No more should the state have to step in to investigate New London for corruption and incompetence. I considered that all over and done with after the conclusion of the one-man grand jury investigation into Kevin’s death in 1978.

    Now we move forward. I extend my condolences to Harvey Mallove’s family, and especially for all the suffering they have had to endure because of this. I extend my condolences to Paul Hansen’s family, and especially for the misery that he let befall his life. I do not rejoice at the undue hardships that fate heaps on any person.

    Many helpless victims

    There are so many others, not named here, who became hapless victims of the whirlwind that spun from this tragedy. I hope they, too, have found peace in their lives.

    As for me, it took a long time to enjoy Christmas again. The change happened when I could again recognize that the date was less about a death and more about a birth.
    Thirty-five years later, I hope it is better in New London. I pray that if another mother must get such terrible news – that her child has been killed – she can fully trust the people who should be helping her find the answers.

    This chilling documentary relates the painful story of Johnny Frank Garrett, who was convicted of murder and executed by the state of Texas. Arrested as a teenager, the mentally challenged Garrett always maintained his innocence. Although law enforcement officials declared that Garrett was guilty of the rape and murder of an elderly nun in 1981, theories abound that the over-eager district attorney and incompetent pathologist bungled the case.

    EQUAL JUSTICE FOR ALL ?

    It contains a riveting account of the hit and run death, of Kevin B. Showalter, a 20 year old Mitchell College student, who was killed on Christmas Eve 1973, in Connecticut and its cover-up. It is a must read for the detailed reporting on the mockery of justice.

    I have no connection to the author, book, or the publisher. I did e-mail the author, to express admiration, for his compelling revelation of the judicial corruption in Connecticut.

    Andy Thibault’s Law And Justice In Everyday Life is an unusual, perhaps extraordinary book. But then Andy Thibault himself is an unusual, and probably extraordinary man. In this day and age, he is a bit of an anomaly, sort of a gunslinger from the Old West, ready to fire at anything that moves – especially if he doesn’t take kindly to the movement.
    After more than 40 years of extensive dealing with the news media, I view the relationship much as my commanding colonel viewed me as (non-lawyer) legal officer, a 21-year-old second lieutenant, U.S. Marine Corps. “Lieutenant,” said he, a fine figure of a man straight from central casting, “we have five fighter squadrons and 2,000 men and women to worry about in this Aircraft Group. I’m stuck with you because the Corps has run out of lawyers for the moment. Let’s have an understanding. I view the legal branch as a thorn in the side of command. It annoys me constantly, but one doesn’t remove it for fear of hemorrhaging. So hear me carefully: keep us out of trouble, and you will live like a lieutenant colonel. If legal trouble overtakes us, your ass is grass.”
    The press can be fairly categorized in the same way. Reporters and columnists are at once a bastion of liberty and a colossal annoyance. But never let anyone doubt that crooks and corrupt or lazy politicians of every kind live in terrible fear of press scrutiny and limelight. Exasperating as they can be, reporters do more than any other entity to keep America right side up. Andy Thibault is dedicated to that kind of watchdog, and often howling dog, First Amendment duty. In Connecticut, cops, lawyers and judges who are less than stellar in their service must twitch nervously the moment Andy pokes his nose into their business. Although he uses both the broadsword and the scimitar in his reportage he inclines toward the former as a weapon of choice. It is somewhat amazing that despite the high station of some of those he has pummeled – usually for good cause – no one has yet framed him and convicted him, or had him rubbed out. He is nothing if not more courageous than was Zorro.
    But there is a softer, sentimental and caring side to his writing which counterpoints nicely with his bellicose aggression toward the unworthy. He has a well-developed sense of the little sensitivities that reside in the human spirit. He is in a way a corollary of Robin Hood; he takes from the powerful and gives to the weak.
    This book – which is mainly about public officials, police, judges and lawyers either shaming or shining – is a good read. Many of the stories stand alone, like slices of life. Others will appear early in the book, with follow-up chapters later. The crown jewel, in my view, is his handling of the strange death of Kevin Showalter, who was slammed 50 feet down the road in New London, Connecticut on Christmas Eve 1973 while changing a tire on the traffic side of a parked car. For many years, Andy Thibault dogged a case which public officials seemed determined to let die, despite the presence of a likely suspect. He tells me his mentor, John Peterson, broke the case open and then handed over the torch. Joined by the victim’s mother, Lucille, who revealed herself as a determined but delightful woman as the story unfolds, Andy beats up on police, prosecutors, judges and governors until finally there is action. Spurred on by an appointment hastened by Gov. Ella Grasso, Judge Joseph Dannehy conducted one of the most brilliant and thorough investigations I have ever seen. If this book were only about the Showalter case, it would be worth the price.
    But there is more – much more – and the reader will inevitably wind up wishing that his community had an Andy Thibault as its own Knight, ready to take on whatever dragons, or snakes, that need to be deflated.

    F. Lee Bailey gained international renown for his sharp cross-examination skills in 1966, when he won an acquittal for Dr. Sam Sheppard in the case that inspired the television series and movie, “The Fugitive.” His other clients have included Patty Hearst, Albert DeSalvo and O.J. Simpson.

    Judge Beverly Streit-Kefalas is one of the most qualified Probate Judges in the state. Her knowledge and compassion for the citizens of Milford is unmatched and the voters of Milford have expressed that view over and over. Additionally her fellow Judges have expressed their confidence in her by electing her to leadership positions with-in their assembly.

    CT Advocate, I am sorry that you have a need to shoot at good people, Milford is very proud of Judge Beverly and her good work.

  3. Very hard to believe that they put the Milford Probate Judge Beverly Streit-Kefalas on any committee, her court is a mess and she lacks the legal probate knowledge that you would think is needed to be a probate judge, she can only fool the people of milford for so long.
